2.2. Each order requires full acceptance of these General Conditions of Sale. By sending the order, therefore, the Customer declares to have read the General Conditions of Sale available on the Site and to accept them in full.
2.3. These General Conditions of Sale are drawn up in Italian and are applicable only to Sales Contracts concluded through the Site by Customers who reside and indicate a delivery address in Italy or Europe.
2.4 The site can be accessed from all over the world but shipments can only be made in Italy and Europe
2.5. In order to make purchases through the Site, the Customer must have the age of majority (18 years) and the ability to act, which the Customer declares to possess.

3 Products: information and availability

3.2. The information relating to the Products is shown on the Site, for each Product, through textual and photographic content.
3.3. The photographic contents have the sole purpose of presenting the Products for sale. Since the chromatic aspects may not represent the real Product with absolute fidelity, also due to the browser or monitor used by the Customer, for these aspects, the absolute coincidence between the image on the Site and the real Product is not guaranteed.
3.4. The Products are sold with the characteristics presented on the Site at the time the order is placed by the Customer.
3.5. The availability or non-availability of the Products is indicated on the Site, for each Product. The sale of the Products is subject to availability on the Site, and it will not be possible to proceed with the purchase of Products presented as not available on the Site. available.
3.6. If, for any reason, the Products already ordered by the customer prove to be unavailable for sale, Zoe & amp; co srl will promptly notify the Customer and reimburse, in favor of the Customer, any sum already paid, and will not exist, for Zoe & amp; co srl, the obligation to deliver the ordered goods.
3.7. If an ordered Product is listed at an incorrect price, due (for example) to an error by Zoe & amp; co s.r.l., the customer will be informed of the error and will receive a refund of the price paid. In this situation the Product will not be shipped.
3.8. Zoe & amp; co srl reserves the right to change the information relating to each Product, the assortment of Products on the Site and their availability at any time and without notice.
4.1. The order sent by the Customer has the value of a contractual proposal and involves the knowledge and full and unreserved acceptance of the General Conditions of Sale in force at the time of the order.
4.2. Zoe & amp; co srl reserves the right to modify these General Conditions of Sale at any time, at its sole discretion and without notice. Any changes made will be considered valid from the date of publication of the document on the Site and will only be applied to orders placed after that date.
4.3. In order to proceed with the purchase of the desired Products, present on the Site and available for sale, the Customer must enter the Products of interest in the virtual cart. 4.4. On the occasion of the purchase, the Customer must provide their personal data required to complete the order and the sales contract.

5.1. 5.3. The selling price of the Products is the price in effect at the time of the order on the Site.
5.4. Zoe & amp; co srl reserves the right to change the prices of the Products and the management and shipping costs at any time and without notice.
5.5. Zoe & amp; co srl constantly checks that the prices shown on the Site are correct. However, due to technical problems not detected immediately, it may happen that the price reported for one or more items is clearly lower than the price normally applied, even net of any discounts and / or promotions in force.
5.6. If the Customer finds that the price of one or more of the Products available for purchase is clearly lower than that normally applied, even net of any discounts and / or promotions in force, he is requested not to complete the order procedure for the aforementioned Products and to promptly report the anomaly with an email to the email address @ gmail.com. 6 Shipping and delivery
6.1. The expected delivery method is shipping by Express Courier and home delivery;
6.2. Standard national and European shipping (excluding Switzerland and UK) by courier will be free.
6.3. The indicative and non-binding delivery times for the expected shipping method, barring unforeseen circumstances, are 2/4 working days throughout the national territory (for the smaller islands, two additional working days are foreseen). For international shipments the approximate delivery times are 2/10 working days.
6.4. Working days are all those included between Monday and Friday, inclusive, therefore excluding Saturdays and Sundays and any midweek holidays.
6.5. Zoe & amp; co srl undertakes to do everything in its power in order to comply with the delivery times indicated on the Site and, in any case, to carry out the delivery in a maximum time of 30 (thirty) days starting from the day following that in which the Customer has sent the order.
7.1. The customer can choose between the following payment methods:
- Credit card (Visa, MasterCard and Maestro circuits)
7.2. In case of payment by credit card, the credit card details will be communicated directly to Shopify or Paypal which deals with electronic payments on behalf of Zoe & amp; co srl. The transmission of such data will take place through encrypted transmission protocols with 128 bits SSL (SecureSocketLayer) system and such data will not be accessible to Zoe & amp; co srl. The amount will be debited at the time of order fulfillment. To ensure the highest level of security and minimize the risk of third parties accessing the Customer's bank details, the Customer will be required to enter his credit card number for each new order, if this is the chosen payment system.
7.3. In case of payment through PayPal, the Customer will be transferred to the payment page prepared by PayPal, where, using the credentials of his PayPal account, he will be able to complete the payment procedure. The transmission of the customer's credentials will take place through encrypted transmission protocols with 128-bit SSL (SecuretSocketLayer) system directly on the page prepared by PayPal, and such data will not be accessible to Zoe & amp; co srl. The amount will be debited at the time of order fulfillment.
7.4. In the event that it is not possible to fulfill the order by Zoe & amp; co srl due to unavailability of the selected Products, the order will be canceled and the amount of the order, if already paid, will be refunded to the Customer. In the event that the debit of the amounts due by the Customer is not possible, for any reason, the purchase process will be canceled and the order canceled
7.5. The Customer agrees to receive the receipt relating to the purchase made exclusively in electronic format.
7.6. The Customer may request the issuance of the tax invoice only during the order process, subsequently entering, where required, their VAT number and unique code or their Tax Code. It will not be possible to request an invoice after completing the order.
8 Right of withdrawal and return procedure.
8.1 Without any explanation, the Customer has the right to cancel an order or part of an order within fourteen (14) days (“cancellation period”). This cancellation period begins with the receipt of all products within the order and ends fourteen (14) days from that date.
8.2 The Order is considered received when the Products within it come into physical possession of the Customer or a third party indicated by the latter.
8.3 To effectively cancel the order or part of the order, it is necessary to clearly communicate the intention to cancel it to firstname.lastname@example.org
8.4 Before returning the goods, the Customer must wait for the receipt of the return authorization form, which will be sent by e-mail following receipt of the declaration of the will to exercise the right of withdrawal by the Customer, if communicated within the terms and in the manner described above.
8.5 Following this communication, the Product or Products must be returned to Zoe & amp; co s.r.l. at the expense of the Customer, without delay, and in any case no later than fourteen (14) days from the date on which the cancellation of the order was communicated, by inserting the form referred to in art. 11 of these Conditions of Sale.
8.6 It is advisable to obtain proof of postage for such returns.
8.7 It will not be possible to exchange purchased goods. In the event that the Customer wishes to exchange goods, he must return the purchased Product as written in the previous paragraphs, and proceed with a new order.
Products returned making use of the right of withdrawal must be new, in excellent condition, and must only have been tested, therefore without signs of wear or dirt. The Products must be returned in their original packaging and equipped with all accessories, instructions for use and labels intact, together with the transport document present in the original packaging, taking care to remove or obscure any label or material. concerning the previous shipment.
8.8 If the returned Products do not comply with the requirements or the terms and conditions for exercising the right of withdrawal are not respected, the withdrawal will not be effective. In this case, the Customer will not be entitled to a refund of the sums already paid. 8.10 The non-acceptance of the returned Products will be reported to the Customer by e-mail.
8.11 Zoe & amp; co srl is not responsible for reimbursement relating to Products shipped but not received by Zoe & amp; co srl due to loss, theft or damage or other causes not attributable to Zoe & amp; co srl.
9 Effects of withdrawal:
9.1 Zoe & amp; co s.r.l., in the event of cancellation of the entire order, will reimburse all payments received including, if made, those relating to delivery costs to the customer who has correctly exercised the right of withdrawal. In the event of partial cancellation of an order, the price of the returned products will be refunded in proportion to each returned item.
9.2 However, the higher cost resulting from choosing a particular delivery method other than standard delivery will not be refunded.
9.3 within 14 days of receipt of the Product and the returned Products. If the cancellation occurs before the order is shipped, the refund will be made within fourteen (14) days of receipt of the decision to cancel the order.
9.4 Unless otherwise agreed with the Customer, the refund is made using the same payment method used for the initial transaction. The User must not incur any costs as a consequence of the withdrawal.
Return shipping costs are borne by Zoe & amp; Co srl.
10 Exceptions to the right of withdrawal
There is no right of withdrawal from contracts:
- for the supply of goods which are liable to deteriorate or expire rapidly;
- for the supply of sealed goods that cannot be returned for reasons of hygiene or related to health protection and have been opened after delivery;
11. Documentation to be attached to the return
Pursuant to art. 54 of the Legislative Decree 6 September 2005 n. 206, is reported to follow the withdrawal form, which the customer can use to inform Zoe & amp; co srl regarding the desire to exercise the right of withdrawal, as an alternative to any other explicit declaration.

12 Incorrect, defective, damaged or misdescribed products and refunds.
12.1 Products deemed non-compliant, because defective, damaged, unsuitable or incorrectly described, can be returned to Zoe & amp; co, s.r.l. who will examine them. Where the vice is recognized, Zoe & amp; co. S.r.l. will send the same product if still available; if not available, it will refund the price of the Product and any shipping costs paid by the Customer, to purchase and return the Product.
12.2 If the defective Product has been sent with other non-returned Products, only the initial pro rata shipping costs will be refunded.
12.3 Refunds will be made within fourteen (14) days of acknowledgment of the defect, using the original payment method.
13 Legal guarantee of conformity
13.1 The rules of the Consumer Code concerning the legal guarantee of conformity and commercial guarantees apply to the Products purchased through the Site.
13.2. The warranty concerns exclusively the presence of defects of non-conformity of the Product. No guarantee is applied in the event of damage to the Product deriving from the Customer's negligence or from use and / or washing of the Product that does not comply with that of the Product and / or the indications provided by Zoe & amp; co srl and / or reported in the documentation. attached to the Product, in tags, labels or in its packaging.
13.3. In order to take advantage of the guarantee, which has a legal duration of two years from the delivery of the goods, the Customer must report the lack of conformity to Zoe & amp; co srl no later than two months after discovery, by sending an email to @gmail. com containing:

- An indication of the defect and / or non-compliance found;

13.4. Should Zoe & amp; co srl deems to authorize the return of the Product, only for cases of faulty or non-compliant goods, the return will be made by courier at the expense of Zoe & amp; co srl. After receiving the goods and having carried out the quality checks, in the event that the non-conformity of the Product is found, Zoe & amp; co srl will proceed with the refund using the same payment method used by the Customer when purchasing the Product.
14 Liability and exemptions
14.1. Zoe & amp; co srl cannot be held responsible for the failure to execute the order on schedule, or for the failure to execute the Sales Contract, in the event that the same are due to unforeseeable circumstances or force majeure or for any reason in any case. not attributable to Zoe & amp; co srl.
14.2 In any case the maximum liability of Zoe & amp; co. S.r.l., for slight negligence, for any loss or damage, pursuant to these Terms of Sale, will be limited to the total price of the Customer's order.
14.3. The aforementioned limitations of liability do not apply to cases of willful misconduct, gross negligence, compulsory liability.
15. Additional important terms
15.1 Zoe & amp; co s.r.l. may transfer its rights and obligations to third parties, but this will not affect the Customer's rights and obligations.
15.2 Each of the sections and paragraphs of these Terms operates separately. In the event of inapplicability of one or some of them, the remaining sections or paragraphs will remain in full force and effect.
16 Applicable law and competent court
16.1. These General Conditions of Sale are governed by Italian law, and the contracts are intended to be concluded in Italy.
16.2 The Court of Vicenza will be competent for any dispute arising from the application and / or interpretation of these conditions and the sales contracts.
17 Intellectual property
17.1. The trademarks, names, textual and graphic contents, illustrations and images reproduced on the Site cannot be used except in an exclusively private context.
